1. Acceptance of Terms

Welcome to Golfer. These Terms of Service ("Terms") govern your access to and use of the Golfer mobile application, website, and related services (collectively, the "Service") provided by Golfer ("we," "our," or "us").

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Golfer is a social platform for golfers that enables users to:

• Create profiles and connect with other golfers
• Track golf scores, statistics, and performance history
• Find and schedule rounds with compatible players
• Organize and participate in leagues, tournaments, and events
• View leaderboards, rankings, and competitive standings
• Communicate with other users through the platform

3. Account Registration

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized use of your account

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. User Content & Data

4.1 Your Content

You retain ownership of the content you submit to the Service, including your profile information, photos, scores, and communications ("User Content"). However, by submitting User Content, you grant us the following rights:

• A worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, display, and distribute your User Content in connection with operating and promoting the Service
• The right to display your profile, scores, and statistics to other users of the Service
• The right to include your performance data in leaderboards, rankings, and competitive standings
• The right to use your User Content to create aggregated, anonymized datasets

4.2 Score & Performance Data

By entering scores and performance data into the Service, you acknowledge and agree that:

• Your scores will be visible to other players in your groups, leagues, and events
• Your scores may appear on leaderboards accessible to other users
• Your performance statistics may be shared with league administrators and event organizers
• We may use your scores and statistics to generate analytics, insights, and reports
• Aggregated or anonymized versions of your data may be shared with third parties

4.3 Data Usage Rights

You grant us the right to:

• Aggregate your data with data from other users to create anonymized datasets
• Use aggregated data for research, analytics, and business purposes
• Share aggregated, anonymized data with third parties, including golf courses, equipment manufacturers, media outlets, and business partners
• Create derivative works, statistics, and insights from aggregated data
• License or sell aggregated, anonymized data to third parties

5. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Impersonate any person or entity or misrepresent your affiliation
• Submit false, misleading, or fraudulent scores or information
• Harass, abuse, or harm other users
• Post offensive, inappropriate, or objectionable content
• Spam or send unsolicited communications
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated means to access or collect data from the Service
• Circumvent any security features of the Service

6. Leagues, Events & Competitions

The Service allows users to create and participate in leagues, tournaments, and events. By participating, you agree that:

• League administrators may access your scores, statistics, and performance data
• Your performance may be publicly displayed on leaderboards and rankings
• You will abide by the rules established by league administrators
• We may feature league results and statistics publicly
• We are not responsible for disputes between users or league decisions

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Golfer and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written permission.

8. Third-Party Services

The Service may contain links to or integrate with third-party services (e.g., Google Sign-In, Apple Sign-In). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of any scores, statistics, or handicap calculations. We are not responsible for the accuracy of information provided by other users.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLFER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or your data
• Any interruption or cessation of the Service
• Any conduct or content of third parties on the Service
• Any disputes between users

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Golfer and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your User Content, or your violation of these Terms.

12. Termination

We may suspend or terminate your account at any time for any reason, including if we believe you have violated these Terms. You may delete your account at any time through the app settings or by contacting us.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

14. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Golfer regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
